Voted in the National Assembly almost unanimously on October 3, during the examination of the “full employment” bill, and definitively adopted on November 14, these measures bring together the rights of these disabled workers. with those provided for all employees in the Labor Code.

“Assimilated employees”

The 120,000 disabled people who currently work in nearly 1,400 Esat have until now benefited from “reinforced support” but did not have the rights opened to employees by the Labor Code. The measures adopted, however, remain “incomplete,” the ecologist regretted at the time. Sébastien Peytavie. The latter had defended several amendments in vain, including one asking to shorten the duration of “abnormally long” trial periods for these workers.

They have also still not obtained the status of employee, but that of “equated employees”, while remaining users of a medico-social structure. These disabled workers do not receive a salary but compensation, which varies between 55 and 70% of the minimum wage, and which is supplemented by the Allowance for Disabled Adults (AAH). At the same time, they will continue to be protected against dismissal.

MP LR Thibault Bazin for his part raised “the question of the cost of these measures for employers”, asking “what compensation will be provided for Esat? “. A mission to rethink the Esat economic model must see the light of day, announced the Minister of Labor Olivier Dussopt.
