A 43-year-old woman is said to have stumbled on the stairs at Gilching-Argelsried train station and dragged a 56-year-old federal official down a few steps on his way home. The Gilchinger sustained serious knee injuries in the fall. The patent examiner had to be operated on twice and was unable to work for a long time. The accident on the way to and from work happened in November 2017 and has now been heard before the 10th civil division of the Munich II Regional Court. But now Judge Johanna Müller-Graff has dismissed the lawsuit. According to the evidence, she was not convinced that the woman acted culpably and that was why the federal official fell, the district court said. During the hearing, the woman stated that she had stumbled, but had not carried the man away or brought him down. The woman reported that she only caught the man’s glasses at the moment, which caused them to fall to the ground.

The official from Gilching was also questioned in the recourse process. Accordingly, the man only noticed that someone was stumbling behind him. However, he saw nothing – and then everything happened very quickly. For him it was “jerky down the stairs,” said the man. Due to these statements about the lack of perception, the accusation against Feldafingerin was not substantiated, the proof of her guilt was not provided, the court decided. After all this, it remains unclear why the officer finally fell on the stairs, the judge justified her decision. In any case, the court could not recognize any culpable or negligent conduct on the part of the woman.

The woman from Feldafinger got off in Argelsried to visit a friend. The defendant told the court that she slipped and caught the man’s glasses with her arm. She apologized to him and promised to pay for the repair of the damaged glasses.
