Chamber of Pharmacists sues over Viagra advertising – Munich

Is this an advertisement for Viagra or just for online delivery? On Monday, the Munich I Regional Court heard a lawsuit brought by the North Rhine Chamber of Pharmacists against a Munich company due to advertising distributed via the Instagram platform. Although no verdict was reached on Monday, the company’s interpretation was not correct on Monday, saying it was only about general online advertising. The commercial was “about nothing other than Viagra,” said the presiding judge. In addition to this question, the legal construct of the sale also plays a role. The Wellster Healthtech Group, the defendant, is based in Munich, but the process also runs through companies abroad. Here too, according to its statements, the court did not seem to follow the defendant’s arguments.

The advertising ended up with the press spokesman for the Chamber of Pharmacists, among others, as he confirmed. The regional court had already banned the advertising by means of an interim injunction. The Chamber of Pharmacists sees the video as prohibited advertising for a prescription drug – specifically Viagra. A decision is expected on November 13th.
