Less than a year ago, the star chef was sentenced to millions in prison for tax evasion. He fought against the verdict at the Federal Court of Justice – and has now largely failed.
The conviction of star chef Alfons Schuhbeck for tax evasion is largely final. The Munich I Regional Court only had to renegotiate aspects of asset recovery, the Federal Court of Justice (BGH) announced on Monday in Karlsruhe. The district court’s judgment was incomplete “because not all the information needed to calculate the defendant’s income tax debts had been determined.”
The revision of the 74-year-old was largely unsuccessful. According to his spokesman, Schuhbeck only has to go to prison when another chamber of the regional court has made a final decision on the confiscation decision. In October 2022, the Munich I Regional Court sentenced Schuhbeck to three years and two months in prison. With such a high penalty, probation is no longer possible.
According to the court, the prominent chef had smuggled around 2.3 million euros past the tax authorities. According to the court in Karlsruhe, the regional court had decided in accordance with previous BGH case law that the tax offenses had already been completed. There were also no legal errors in the sentencing. “The judgment is therefore essentially final.”
Schuhbeck’s lawyer Ali B. Norouzi stated: “Mr. Alfons Schuhbeck has made use of his legitimate legal remedies and accepts the decision of the Federal Court of Justice. Already in the proceedings before the Munich Regional Court, Mr. Schuhbeck underlined that he accepts responsibility and is trying to fully compensate for the damage to make up for height.” The public prosecutor’s office did not appeal the verdict.
