In the trial about rape following role play and bondage play, the defendant refused to testify before the Munich II Regional Court. On Thursday, he did not want to comment on the allegations or his personal circumstances, as his defense announced. The 39-year-old is charged with particularly serious rape, grievous bodily harm and deprivation of liberty – among other things because he is said to have ignored a woman’s so-called safe word and continued.

According to the public prosecutor’s office, the two had previously met frequently for consensual sex and role play, which also included rape fantasies. The two had agreed on a safe word as a security precaution for their meetings. Accordingly, they had agreed that the man would stop immediately if the woman said “black heart”.

The situation is said to have escalated at a meeting in Egling in the Bad Tölz-Wolfratshausen district in 2022. The woman wanted to end the sexual relationship at the time, but initially did not resist when the man tied her up and beat her. When she asked the 39-year-old to stop using the safe word “black heart”, he initially did so, but then grabbed her again, tied her up, beat her and raped her.

At the start of the trial, the alleged victim’s lawyer requested that her client’s statement be excluded from the public. The woman is “still suffering from panic attacks” and is “mentally unable” to meet the defendant in the courtroom. The interrogation should take place via video transmission. The defendant “tried immediately after the crime to force the witness to withdraw the complaint,” said her lawyer. The woman has been receiving psychological treatment since November 2022. The court has scheduled four days of hearings for the trial.
