The State condemned for the lack of teachers and lost class hours

A teacher not replaced means hours of lessons lost for the students. For this damage, the State was condemned on Wednesday by the administrative court of Cergy-Pontoise. The procedure is part of the national collective operation #WeWantTeachers. In 2022, it initiated proceedings against the State in various places in the country to obtain that it ensures the organization of the public service in the case of teacher absences.

At the Cergy-Pontoise court, twelve cases were subject to the jurisdiction of “students [qui] complained of having been deprived of a very significant volume of cumulative absence hours during the same school year (…) without the rector of the Versailles academy being able to justify necessities inherent to the organization of the service”.

Required compensation

“The court recognized the State’s liability in eight cases and ordered it to compensate the eight applicants for damages arising from the loss of their children’s chance to succeed in their future years and school courses due to the break in continuity educational”, indicated the jurisdiction in a press release.

In two judgments dated April 3 published on its website, the court ordered the State to pay 150 euros to the families for the damage suffered. He also returned three cases and rejected one request.
