Seized in summary by the environmental movement which challenges the decree of dissolution of the government, the administrative jurisdiction decided this Friday, but must still decide on the merits.
A snub for the government. Referred to in summary proceedings by the environmental movement Les Uprisings of the Earth, the Council of State suspended this Friday August 11 its dissolution pronounced by the executive at the end of June.
The judges of the highest administrative court debated on Tuesday the interim suspension filed by the environmental movement at the end of July during a three-hour hearing, and had put their decision under advisement. This emergency appeal, which does not presage the final judgment, aimed to suspend the dissolution ordered by the government on June 21 if there were “serious doubtson the legality of the decree issued by the Council of Ministers. The judges will therefore still have to decide on the merits, which should take more than a year.
Legal arm wrestling
The Uprisings of the Earth, whose appeal was supported by several associations and parties, including EELV and LFI, has been engaged for several months in a legal showdown with the government. Interior Minister Gérald Darmanin had announced that they would be dissolved before the Assembly on March 28, after the violence during the demonstration against the mega-basins in Sainte-Soline.

After several months of hesitation at the head of state, the decree of dissolution was finally taken by the Council of Ministers on June 21. The government stated that “under cover of defending the preservation of the environment», the nebula of associations would encourage «the commission of sabotage and material damage, including by violence“. The movement, for its part, has denied any violence from the start, believing that the “damage to property does not endanger the life of othersand assuring in any case that he had never called for such actions. The Uprisings of the Earth also ensure that they are not a “de facto group” – the legal qualification which allows them to be dissolved even though they do not have a legal existence such as an association – but a “current of thought based on a vast movement, devoid of leaders or identified members“.
