Just a few days ago, the 2G rule in Bavaria was repealed. And now also in Baden-Württemberg. The operator of a stationery shop had complained.

Unvaccinated people are allowed to go shopping again in Baden-Württemberg for the time being with a current test. The Administrative Court in Mannheim overturned the 2G rule for retail.

Freezing alarm level II through the state government’s Corona Ordinance is likely to be illegal, the VGH announced. The 2G rule provided for therein will be suspended with immediate effect. For the time being, this means that in addition to those who have been vaccinated and those who have recovered, people with a current test (3G) are also allowed to shop in stores.

A woman from the district of Ortenau, who runs a stationery shop, had complained. She complained that stationery shops, unlike flower shops, are not part of the basic supply. In the latter, the 3G rule applies despite Alert Level II. That is unequal treatment.

In Bavaria, the Administrative Court also overruled the 2G rule five days ago. For the green-black government in Baden-Württemberg, it is the second setback within a few days. Only on Friday did the Mannheim judges agree with an unvaccinated student in a similar matter. He had complained that alert level II led to the extensive exclusion of non-vaccinated people from face-to-face events.

Concerned about the omicron variant of the corona virus, the green-black state government had retained alarm level II in the Corona Ordinance and thus overridden the limit values ​​​​for the burden on hospitals by the end of January.

The Mannheim judges have now declared again that a provision that expressly provides for far-reaching access restrictions for unvaccinated people, regardless of the 7-day hospitalization incidence, is not in line with the federal Infection Protection Act.
