It is the first act of a real tragedy which will be judged this Monday and Tuesday by the children’s court of Senlis, in the Oise. Four young men, all minors at the time, are suspected of sexually assaulting a teenage girl one afternoon in August 2017 and filming the scene. But the victim, Shaïna Hansye, who was then 13 years old, will not be present on the bench of the civil parties. She was murdered two years later, on October 25, 2019. Stabbed and then burned alive in a shed 500 meters from her home, in Creil. The main suspect, also a minor, will appear later. If the two cases are legally distinct, the first drama undoubtedly sheds light on the second.
“This first case created a highway for the future,” said family lawyer Me Negar Haeri. When you have the end of the case in mind, you understand how this collective rape will weaken the victim and lay the groundwork that will lead to his loss. Initially indicted for rape in a meeting, the three youngest will finally answer for sexual assault and violence in a meeting. Shaina’s former boyfriend will also be tried for “serious pressure” to obtain sexual favors and recording pornographic images. They incur up to 3 and a half years of detention, because of their minority at the time of the facts. The fourth defendant is appearing for a sexual assault allegedly committed a week earlier.
An assault filmed and broadcast on social networks
Back to the end of summer 2017. Shaïna is just 13 years old, her boyfriend, Ahmed*, a year older. The two teenagers met a few weeks ago. However, according to the testimony of the best friend of the teenager, this relationship is not a banal love affair. To the investigators, the latter describes a violent boy, who hits her and humiliates her. This August 31, precisely, Ahmed would have threatened Shaïna to reveal on social networks photos of her naked – shots obtained under duress – if she does not join him in a disused clinic, a place, now destroyed, where the young people from Creil met sometimes.
According to the story recorded in the teenager’s complaint, as soon as she arrived, her “boyfriend” would have pulled her by the hair to an isolated room and then ordered her to give him oral sex. While she refuses, two other teenagers arrive. They hold her down, undress her before making her undergo a digital penetration then with a tube of Labello. Statements that will remain constant throughout the instruction.

The same evening, Shaïna goes with her mother to the police station to file a complaint. But almost immediately, his word is questioned. The forensic pathologist who examines her notes many bruises, especially on the inside of her thighs, but nevertheless begins her report with this statement: “we do not perceive any affect, sadness, shame or feeling of guilt”. , in the victim. The policewoman who collects her testimony annotates in capital letters: “DO NOT MANIFEST ANY PARTICULAR EMOTION”. In 2017, at the time of the events, the state of amazement had nevertheless been recognized and documented for a long time. “How can she feel strong when her status as a victim is questioned? “Asks Mr. Negar Haeri. And to insist: “She ends up internalizing this disrepute, by believing in all the insults of which she is the victim. »
Throughout the procedure, the respondents have constantly denied, claiming that it was Shaïna who allegedly harassed her boyfriend. Contacted by 20 minutes, the latter’s lawyer, Me Archibald Ceyleron, did not respond to our requests. If the young girl is no longer present to make her voice heard, videos will speak for her. One of them, erased from Ahmed’s phone, was exhumed during the investigations: we see the naked victim being insulted, violent while trying, somehow, to defend himself. Other videos were posted on Snapchat, forging the teenager’s reputation as an “easy girl” within the city, causing her to experience two years of humiliation and violence. In May 2019, when she chanced upon Ahmed in the street, she was notably beaten up for having “dared” to file a complaint.
Victim “cubed”
“Shaïna is a victim cubed, each case paves the way for the next, the violence does not add up but multiplies”, says the family lawyer. It is during the summer following her beating that she will meet her new boyfriend. He is 17 years old, she celebrated her 15th birthday on August 11. He admits to having approached the young girl because of her reputation. Two months after their first meeting, his naked body, stabbed three times, partly charred, will be discovered in a shed in Creil. The autopsy will reveal that she inhaled smoke, proof that she was still alive when she was immolated by fire. She also confirmed a rumor circulating in the neighborhood: she was ten days pregnant when she was killed.
Her boyfriend, indicted for murder, has constantly denied the facts. One of his friends, however, told investigators that he had confided in him the night of the murder. “I smoked it…”, he would have told her while he still had blood in his sneakers. Fellow prisoners – he was placed in pre-trial detention – also reported that he boasted of his gesture, preferring to take “thirty years rather than being the father of a bastard (…), of a son of whore”. “Reputation is a deadly weapon, especially with social networks,” insists Me Negar Haeri.
