Rape in a children’s home in Wunsiedel: Public prosecutor’s office appeals – Bavaria

In the trial surrounding the death of a ten-year-old in a children’s home in Wunsiedel, Upper Franconia, a 26-year-old was sentenced last week to seven and a half years in prison for raping the girl. Now the public prosecutor’s office and the lawyer for the 12-year-old co-plaintiff have filed an appeal, as a spokesman for the Hof regional court announced.

Last Wednesday, a youth court found the defendant guilty of, among other things, rape and serious sexual abuse of children. He is said to have raped the ten-year-old on the night of April 4, 2023 after breaking into the home.

A then eleven-year-old boy from the home is said to have killed the girl during an argument later that same night. The now twelve-year-old cannot be prosecuted criminally. Since he was also said to have been sexually abused by the defendant that night, he was admitted as a co-plaintiff in the proceedings.

The 26-year-old garbage worker, who had previously stayed in the home several times, confessed to the rape in the trial, but denied involvement in the girl’s death. This was also not part of the indictment.

After the girl’s death, the Hof public prosecutor’s office continues to investigate unknown persons for breach of duty of care or parenting. A spokesperson said the investigation is currently scheduled to be completed by the end of June. The results of the investigation were originally expected by the end of March.
