More than two years ago, the Thuringian AfD was classified as right-wing extremist by the State Office for the Protection of the Constitution. So far, the state association has not taken legal action against it.

According to its own statements, the Thuringian AfD is planning a lawsuit against the state protection of the constitution. The party wants to take legal action against individual findings in the 2021 constitutional protection report, said Thuringia’s AfD co-boss Stefan Möller of the German Press Agency.

A very detailed chapter is dedicated to the Thuringian AfD in the report. The background is the classification of the state association with its chairman Björn Höcke as a secured right-wing extremist effort and object of observation in 2021.

“Attacks on the rule of law”

In the report for the year, the AfD is listed under “right-wing extremist parties”. The AfD is reported on almost eleven pages, the text is divided into points such as “attacks on the rule of law”, “violations of the principle of democracy” or “historical revisionism”.

Thuringia’s President for the Protection of the Constitution, Stephan Kramer, told the dpa about the announced lawsuit: “We live in a constitutional state and of course the reports from the Office for the Protection of the Constitution are also accessible to a judicial review. Everyone is free to sue.” If there should be such a lawsuit, he looks forward to it with ease.

This is how Möller describes the strategy

Möller described the AfD’s strategy as follows: “You can carry out a decapitation if you want to fight the opponent, or you fillet him, piece by piece.” We opted for the second option.

The Thuringian AfD was classified as right-wing extremist in March 2021, more than two years ago. So far, she has not defended herself legally against it. Möller explained this with the great effort involved.

If you attack the statement that the party is anti-constitutional, you put yourself in a position where you are inferior. The reason is the size of the authority. In addition, the Office for the Protection of the Constitution has only collected incriminating and no exculpatory material for years.
