“I don’t recognize myself,” claims Kaya T. (all names changed), when the crime video is running in front of the 2nd criminal chamber at the Munich I Regional Court: It shows how the 27-year-old pushes a woman onto the track at the main station – and how the incoming S-Bahn comes to a standstill in time. The jury, however, had no doubts about the identity of the pusher and ordered the man, who suffers from paranoid schizophrenia, to be held on charges of attempted murder.

For the 64-year-old woman, the day will probably have been burned into her memory as a “horror show,” prosecutor Johanna Heidrich said in her plea. Julia M. had just returned from a short vacation with her partner on June 9 and was waiting for the S-Bahn at the main train station at around 9:15 p.m.

At the same time, Kaya T. walked along the platform, kicked a small dog with full force and then hit Julia M’s back with both hands. She first fell on her hands and knees and then fell headfirst onto the track bed. Her partner jumped after her and waved to the driver, who was able to brake and suffered a shock. Julia M. was slightly injured, but is still suffering physically and mentally from the act.

Defense attorney Birgit Schwerdt stated in her closing speech that she saw an attempted homicide, but no sign of murder. Kaya T. is not guilty, so he cannot act insidiously either. However, Judge Norbert Riedmann stated in the verdict that the accused, despite his illness, was able to see that the woman had been unsuspecting and also defenseless when he pushed her from behind, and that she also fell from this height on the heavily frequented route death could have come. “He recognized that and took advantage of it,” said Riedmann.

Prosecutor Johanna Heidrich had seen base motives in addition to the murder characteristic of insidiousness. Kaya T. initially said the woman “got in his way”. He later explained that artists had allowed him to commit the crime. “We couldn’t convince ourselves of a motive,” said the chairman, so you don’t see any base motives.

The placement could not be suspended on probation. T. show no insight into the illness. After his previous stays in the clinic, he would always have stopped taking the pills immediately at home. Kaya T. represents a danger to the general public, further crimes are to be expected.
