Many holidaymakers will be familiar with this: There are no longer any loungers available at the pool, even though many guests are still having breakfast or sleeping. An annoyed plaintiff now gets some money back because of this.

Pool loungers reserved for hours with towels can be an annoying experience for many vacationers. A traveler to Greece has now been awarded a refund by the Hanover district court because he was unable to use the loungers at the pool for most of his vacation.

The family from Bischofswerda in A court spokesman said on Thursday that Saxony was awarded 322.77 euros. The package trip to Rhodes cost them a total of 5,260 euros.

According to court information, the hotel booked had six swimming pools and around 500 loungers. According to the posted rules of conduct, it was forbidden to reserve them for more than 30 minutes without using them. According to reports, the management and staff of the hotel did nothing to address violations. The plaintiff from Saxony saw a lack of travel and demanded 798 euros back.

Peaceful race of early birds by the pool?

With the verdict from the end of December, the court partially agreed with the man. A package holiday could be defective if the organizer either only provides a few pool loungers in a hotel complex or does not intervene if travelers reserve pool loungers for a long time without actually using them, the reason given was.

The plaintiff complained about this several times. According to the court, the organizer saw more of a peaceful race for the coveted spots at the pool with the better end going to the proverbial “early bird.”

The court decided on a travel price reduction of 15 percent of the daily travel price from the plaintiff’s first complaint. The verdict is not final and an appeal is possible.
