Lawsuit against Mercedes – environmental aid fails – economy

The district court of Stuttgart has dismissed a lawsuit by the German Environmental Aid for insufficient climate protection against the car manufacturer Mercedes-Benz. The plaintiffs are not entitled to an injunction to sell combustion engines. The environmental aid announced an appeal before the Higher Regional Court of Stuttgart. She wants Mercedes to stop selling cars with internal combustion engines by 2030 at the latest. The court explained that a balancing of interests between the fundamental rights presupposes that the consequences for the plaintiffs of the behavior to be prohibited by the defendant are at least foreseeable. However, that is not the case here. The claim demanded by the DUH also contradicts the constitutional division of tasks between legislation by Parliament and the courts.
