Hessian AfD may be observed by the Office for the Protection of the Constitution

The Hessian state association of the AfD is a suspected case for the Office for the Protection of the Constitution. There is enough evidence of a threat to human dignity and the principle of democracy.

The Hessian regional association According to a decision by the Wiesbaden Administrative Court, AfD can be observed by the State Office for the Protection of the Constitution as a so-called suspected case.

After its decision on the urgent application, the court announced that there was “sufficient factual evidence of efforts by the Hessian state association of the AfD that were directed against the free democratic basic order in the form of the guarantee of human dignity and the principle of democracy.”

At the same time, the administrative court ruled that the State Office for the Protection of the Constitution (LfV) had unlawfully informed the public in a press release about the AfD’s observation. For this reason, the LfV is obliged to publish a new press release, according to which it must temporarily refrain from announcing that the AfD is being monitored or is a suspected case. The decision (6 L 1166/22.WI) is not yet legally binding.
