Has the French state committed gross negligence in failing to protect a child victim of repeated rape?

  • Victim of repeated rapes when she was a child, Karine Jambu attacks the State for gross negligence and accuses it of not having protected her.
  • The facts had taken place at the family home in Rennes, under the eyes of his parents, however never convicted of complicity.
  • Now 23 years old, the young woman hopes to obtain compensation to “protect other children” victims of sexual violence. It would be a first in France.

She doesn’t hide it. ” I am very stressed. Karine too. For her, this hearing is almost as important as the trial at the assizes ”. Laurence Brunet-Jambu apprehends the decision of the Paris Court of Appeal which must deliver its deliberation this Wednesday concerning the fight of his life. A fight she led to protect her niece Karine, raped for years at her parents’ home by a “friend” of the family. A long-broken young woman whom she chose to adopt and who is now waiting for the State to be condemned for her failings. And they are many. “More than ten reports”, as explained by his lawyer Me Grégory Thuan.

In February during the hearing, neither Karine nor her aunt had been able to evoke the ordeal lived during her childhood. Only their lawyer had tried to make the voice of these victims heard. From 2002 to 2005, the then 4-year-old girl had been repeatedly raped by Roland Blaudy, a man hosted by her parents in their apartment in downtown Rennes. The couple had never protected their daughter from the actions of this man, sentenced in 2019 to thirty years in prison by the Assize Court of Ille-et-Vilaine. The mother and the father had been condemned for “witness tampering” but not for complicity, which their daughter bitterly regrets. “Karine thinks about it a lot. This hearing is a way of acknowledging a guilt that has not been recognized for his parents, ”explains his aunt.

Her mother already sentenced for stabbing her baby

At first instance, the court had recognized the state’s “denial of justice”, due to the “unusually long” delay when the Rennes public prosecutor’s office had taken a year to entrust Karine’s case to an examining magistrate. The members of the public prosecutor’s office at the time were not, however, the only ones responsible for this collective bankruptcy which cost the childhood of a little girl that her parents “never loved”. According to all experts in the case, Karine should have been placed “from birth”. The gross negligence was not pronounced on the grounds of “prescribed facts”, which the victims dispute.

His mother Anne-Marie had already been convicted in the past for having killed her baby with 180 stab wounds. The family doctor had, however, produced false medical certificates denying the developmental delays of the girl. The juvenile judge had not been more efficient, nor some police officers responsible for collecting the multiple complaints of the family. The staff of the hospital, teachers, relatives who rubbed shoulders with Karine had however multiplied the reports. In vain.

In a book published in 2018 and entitled Reports, Laurence Brunet-Jambu had crushed the protection of children and justice, regretting that they do not “protect the victims of pedophiles”. This Wednesday, the Paris Court of Appeal could be the first in France to condemn the state for gross negligence in a child protection case.

Last year, the European Court of Human Rights had recognized the guilt of the French state in the death of little Marina Sabatier, whose lifeless body was found in 2009 near Le Mans. Karine, now 23 years old, and her aunt hope not to go that far and “trust French justice”. “Malfunctions, they still exist. Karines, there are still some and we let too many things pass. It needs to change “. A historic condemnation could help. The deliberation is expected during the day.
