Unfortunately, the probability is an unclear matter. Whether everything would actually be clear without any probability is in itself a difficult question. But when, as always, a lot is unclear, probability is needed, that’s exactly what it’s there for. But somehow everything that is not absolutely certain or completely impossible is also probable. Only how probably, the question remains. But of course the Federal Criminal Police Office and the district office in Garmisch-Partenkirchen cannot stop there. Both recently described a disruption of the G-7 summit from the air as simply probable – although firstly there is far less room for improvement over Elmau than elsewhere and secondly the security precautions there were recently significantly tighter. It is possible that the G 7 only remained undisturbed with a lot of luck. And your critics just had bad luck.
Not that those critics wished the summiteers to carry out this air raid, which the authorities were considering, or even had it in mind. They would only have liked to demonstrate within hearing and sight, as the constitutional court also considers necessary in principle. But unfortunately: probably disruption from the air. Therefore, the 50 approved demonstrators can only be allowed up to the limit of the inner security area, 520 meters from the castle. Not that they are still standing around in the escape route during the probable disruption from the air or that they are ultimately disrupted themselves, even though they have not been instructed in the safety and evacuation concepts.
Accordingly, this was the reasoning in the urgent decision of the Federal Constitutional Court on Monday afternoon to allow the previous decisions of the Munich Administrative Court and the Bavarian Administrative Court to apply. Even these two decisions were very urgent because of the extremely short-term approval of the demo on Saturday afternoon. And so all the authorities had no choice but to rely on the official risk forecast, according to which there would probably be disruptions from the air. On Monday there was a disturbance on the ground for a few seconds because some demonstrators wanted to sit on the street and thus on the said escape route. They have not made success in a possible main hearing at the Constitutional Court any more likely.
