The process surrounding the Islamist The attack in Vienna in November 2020 must be reopened in parts. The Supreme Court (OGH) partially overturned the guilty verdicts against five supporters of the shooter after an appeal for nullity.
According to the Supreme Court’s announcement, the guilty verdicts for the crimes of the terrorist group and the criminal organization were overturned. According to the Supreme Court, there was an error in the legal instructions given to the jury, and a question about guilt or innocence was not formulated specifically enough.
The trial surrounding the attack, which left four dead and more than 20 injured, ended in February 2023 with life sentences for two defendants and long prison sentences for other defendants. The convictions for committing terrorist offenses in conjunction with involvement in murder are legally binding. The assassin was shot by the police.
The new trial will be limited to whether the men were part of a terrorist group and a criminal organization, it said.
