ECJ on Football Super League: Defeat for UEFA

vFrom the point of view of many who had listened a little to the opinion-forming process, this judgment did not come as a complete surprise, although some officials reacted quite astonished: The European Court of Justice (ECJ) came to this conclusion in the case of a lawsuit by the European Super League Company (ESL). Judgment that the European Football Association (UEFA) and the World Football Association (FIFA) are engaging in an “abuse of a dominant market position” when they prohibit clubs and professionals from taking part in competitions outside their own system under threat of harsh penalties.

“This is a judgment of great historical importance, European football will never again be a monopoly,” said Real Madrid President Florentino Pérez, who is the driving force behind the project, while Philip Krämer (Alliance 90/The Greens), the deputy Chairwoman of the Sports Committee in the Bundestag, explained: Similar to the Bosman ruling, this decision is also “trend-setting and will fundamentally change the structure of modern sport in Europe”. However, he is “sceptical as to whether breaking up the current European sports model will further promote the social function of sport in our society in the long term.”
