The fact that the accused lacks any insight into his actions is reflected in one of the few sentences that the man said in court: “Hasn’t a black man the right to touch a white woman?” he asked the young witness who he had groped on the S-Bahn a little over a year ago. It was just one of numerous offenses for which the 54-year-old had to answer before the Ebersberg district court on Tuesday morning. He was escorted there from the detention center in Stadelheim, accompanied by two police officers, who immediately brought the man back to his prison cell after the trial.
In view of the crimes, Judge Vera Hörauf had no choice but to send the accused back to jail. This should provide relief, especially in a town hall in the central district of Ebersberg, where there have always been problems with the homeless man in the past. This was also the case in September last year, when the drunk accused was said to have been hanging around in the playground of the local elementary school and mobbed on students. According to the indictment, the man is said to have threatened an administrative employee who wanted to send him away with the words “I kill you”. The same statement is said to have been made again a little later in the homeless shelter when the town hall employee wanted to check on things there.
In the local supermarket, the man spat on an employee
However, the man does not only seem to have problems with representatives of the authorities. Another day he is said to have threatened his roommate with a kitchen knife and thrown his things out of the window. The accused is also no stranger to the local supermarket. Despite the house ban, he is said to have appeared there again and again and to have insulted customers and employees. The ugly highlight was an incident in October 2021 when he is said to have insulted the deputy branch manager and finally spat on him.
According to the indictment, the attack on the S-Bahn on the way to Munich also happened last year. In the early morning, the man is said to have sat down opposite a 17-year-old girl before suddenly stroking his hand over her thigh to the pubic area. According to the prosecutor, he only left the victim alone when she got off the S-Bahn at the next possible stop.

Finally, several officers from the Ebersberg police station felt the anger of the 54-year-old. When he ended up in the drunk tank after a night of drinking, he is said to have greeted the police officers the next morning with the words “I’ll kill you all” before turning around, baring his behind and sticking it out at the officers through the bars.
As long as the list of allegations was in court, the accused was taciturn: “I’m not saying anything,” was his comment. But the numerous witnesses had all the more to tell, above all the town hall employee, whom the man had repeatedly insulted. There are always incidents with the accused, especially when he has drunk too much alcohol. In the accommodation, the man first challenged him to a fight before threatening him with an umbrella. “We had never had that before. It was a new quality,” said the administration worker.
The probation officer sees no signs of a change in behavior
The supermarket employee had a similar report. Although the accused was repeatedly conspicuous, he spat for the first time back then – “and that in times of Corona,” as the woman said in court. After all, that was the reason why she personally filed a complaint against him. The young girl that the man had groped on the S-Bahn did the same. He first started talking to her and asked her all sorts of things. “I was totally uncomfortable,” said the 19-year-old in her interrogation. Then he grabbed her knee and stroked her thigh. She immediately got off at the next station, called her mother and drove with her to the police station.
The man, who has many previous convictions, has also made frequent appearances there. One of the officers, whom the accused had threatened and insulted, said in court that she did not know the man soberly at all. It is also unlikely that this will happen at some point. He broke off his alcohol withdrawal after just one day, as the man’s probation officer said. A change in behavior is therefore not to be expected.
The public prosecutor saw it that way too, describing the accused as “neither capable of therapy nor willing to undergo therapy”. Judge Vera Hörauf followed this view and immediately sent the man back to prison. According to the verdict, he will now have to stay there for another year and nine months.
