The government has not said its last word on the index on the senior: “The government wishes that this article (establishing an index of seniors) can be restored during the examination of the text in the Senate”, indicated Wednesday its spokesperson Olivier Véran. Included in article 2 of the bill, this index was rejected by the deputies on Tuesday evening. “This vote [contre l’index] is not understandable. Asked whether the index, which aims to measure the employment of older employees by companies, would be reinstated for companies with more than 300 employees or more than 50 employees, the spokesperson replied that this threshold would be “ to be determined in the next few days.

Financial sanctions in the event of non-publication of the index

The government wants to make the index compulsory from November 2023 for companies with more than 1,000 employees, for those with more than 300 employees from July 2024, and those with more than 50 employees from July 2025, this last threshold having added by amendments from all benches. Employers must be liable to financial penalties in the event of non-publication of the index, but no obligation of result has been set in terms of employment of seniors.

On the sanctions, the government “remains attentive, open both to the National Assembly this week again, and then to listen to the senators when the debate begins there” at the end of February, added Olivier Véran .
