Deal in the mask trial: Probably more than four years in prison for Tandler

The accused of tax evasion amounting to millions Entrepreneur and politician’s daughter Andrea Tandler has agreed to an offer of agreement from the Munich I Regional Court. In it, Tandler admits that she evaded income tax until March 27, 2023. In addition, her business partner Darius N. probably did not provide entrepreneurial support for the mask deals, Tandler said in a confession in a non-public meeting. Tandler has also admitted to evading gift tax. Co-defendant Darius N. confirmed Tandler’s statement. Both have now made up for the resulting tax loss.

The court recommends a prison sentence of 4 years and 3 to 9 months for Andrea Tandler. For Darius N. it is about a year less. The verdict is due to be announced on Friday.

Almost 50 million euros are said to have flowed

At the beginning of the corona pandemic in 2020, the daughter of the former CSU general secretary and former Bavarian finance, economics and interior minister Gerold Tandler brokered mask deals for a Swiss supplier. Customers included various federal and state authorities. Tandler received commissions amounting to almost 50 million euros, which she and her co-defendant Darius N. are said to have not taxed correctly, according to the public prosecutor’s office.

Multiple allegations of tax evasion

Tandler is accused of having taxed the commissions not as an individual, but through a company, which means that significantly less tax is due. Darius N. is also said to have received half of the company shares in the then newly founded GmbH in Grünwald, even though he had not previously contributed anything. The public prosecutor’s office bases its accusation of gift tax evasion on this.

Because the income from the mask shops was taxed in Grünwald, where only around half the trade taxes are due compared to the state capital Munich, the public prosecutor’s office also accuses the defendants of trade tax evasion.

Defendants admit income and trade tax evasion

Through their defense attorney, the two defendants largely admitted the allegations regarding evasion of income and trade tax. The court closed the proceedings on gift tax evasion and corona subsidy fraud on Tuesday with the consent of the public prosecutor.

According to the public prosecutor’s office, overall economic damage amounted to 7.8 million euros.
