In 2018, the public prosecutor’s office in Berlin confiscated several properties, including a clan villa. According to the court ruling, the family must vacate the property. However, she can still appeal the verdict.

A well-known clan of Arab origin has to vacate a villa in the Buckow district of Berlin. The regional court Berlin rejected a corresponding appeal from the family, as a spokeswoman announced on Monday. In addition, with their decision, the judges followed a ruling from the Neukölln District Court (Az: 10 C 485/21) from last April. It is “provisionally enforceable” and no eviction period is granted.

The clan villa and its land are among 77 properties that the Berlin public prosecutor’s office confiscated in 2018. The authorities are convinced that these were not purchased with legal money. Since the confiscation, the property has belonged to the state of Berlin, and the Neukölln district is responsible for it as a municipality. Initially, this did not change the tenancy agreement. However, the district later gave the family notice and set an eviction deadline of the end of October 2021. Since the family stayed, the district went to court – with success.

Rent payments have probably not been made – clan has to vacate the property

According to the district court’s ruling on April 6, the district is entitled to eviction. The reason for this was outstanding rent payments. The district court rightly sentenced the family to eviction “because the tenancy agreement between the parties was terminated without notice,” the regional court said.

The decision, which was made last Thursday, is not yet legally binding. Appeals could be filed with the Federal Court of Justice within a month.
