BGH – judgment on scrap real estate – economy


Even a completely run-down property will probably have to be refurbished by the community of owners if it would otherwise be impossible to continue using it. The Federal Court of Justice (BGH) is heading towards this ruling in a dispute from Augsburg. According to the law, the renovation obligation does not apply if a building is “destroyed to more than half of its value”. But this should only mean real destruction by fire or flooding, as chairwoman judge Christina Stresemann said in Karlsruhe – and no decay. The final decision is to be announced on October 15 (Az. V ZR 225/20)
