Even a completely run-down property will probably have to be refurbished by the community of owners if it would otherwise be impossible to continue using it. The Federal Court of Justice (BGH) is heading towards this ruling in a dispute from Augsburg. According to the law, the renovation obligation does not apply if a building is “destroyed to more than half of its value”.
