The question, which has been troubling entrepreneurs across the Free State for months, could soon be clarified in court: the first lawsuit was received by the Munich Administrative Court on Friday before Pentecost, the BVMW association of medium-sized businesses announced on Tuesday. A Munich-based company is suing “both against the claim for repayment and against the chosen form of the online procedure”.

At that time, Bavaria was the first federal state to set up an aid program for companies that had to close due to the pandemic. Since autumn, companies have had to prove that they received the money correctly. Many entrepreneurs were surprised by the test reports; It is often said that this was never communicated in this way. BVMW spokesman Achim von Michel welcomed “the fact that the first lawsuit has now also been filed in Bavaria”. In North Rhine-Westphalia, companies had already sued against the design of the emergency aid – and were right, according to Michel. The review procedure had therefore to be set up there from scratch.
