What new twist does the extraordinary affair of the disappearance of Delphine Jubillar still have in store? In this case without a body or crime scene, the suspicions of the investigating judges and investigators have been focused for three years on the husband, Cédric Jubillar. The plaster painter was recently referred to the Tarn assizes to answer for the murder of his wife.
His trio of lawyers, who denounce an “empty file” and the “fabrication of a guilty person”, logically exhaust all possible remedies. This Thursday, Jean-Baptiste Alary, Emmanuelle Franck and Alexandre Martin were to contest the indictment order (OMA) taken against their client before the investigating chamber of the Toulouse Court of Appeal. But, they will do it later. Because other, more unexpected questions took over. Two additional pieces of information were in fact requested by the public prosecutor’s office.
Friends of the suspect cited by a fellow inmate
The first of these supplements is linked to a telephone exchange on the case, recorded between an inmate of the central prison of Lannemezan (Hautes-Pyrénées) and his mother, recently discovered and revealed by La Dépêche du Midi. The detainee, who once worked with Cédric Jubillar at the Seysses remand center, is surprised at the possibility of a trial when there “is no proof”. He also cites the first names of three friends of the husband, one of whom owns a white car examined, in vain, by investigators who suspected that it could have been used to transport the body.
The second additional information concerns a man who would have “revelations to make” to investigators.
“The checks which must be carried out can now only be carried out within the framework of this additional information,” Franck Rastoul, the general prosecutor of Toulouse, told AFP. “It is therefore in no way the expression of a deficiency in the instruction, it is a procedural obligation at this stage”, he underlined, adding that “this is part of the logic which since the beginning, prevails in this case and which consists of checking all the leads”.
Water for the defense lawyers
Obviously, Cédric Jubillar’s lawyers interpret these twists and turns differently. “We believe that everything that must be done to seek the truth must be ordered, but admit that it is still a fairly unprecedented situation,” indicated Alexandre Martin, at the end of this closed-door hearing, recognizing that he did not do not know whether the new elements are incriminating or exculpatory. “But we can still consider that it is an illustration of what we have been saying for two and a half years, namely that, while a man is still incarcerated, while an investigation is closed, we surrender realizes that we are still trying to seek the truth (..) What we know above all is that we know nothing,” adds his associate Emmanuelle Franck. For Jean-Baptiste Alary, “all the acts that must be carried out must be carried out in order to know whether it is reasonable or not to send a man before an assize court, where he incurs the maximum penalty. , on the basis of an insufficient file”.
The civil parties, for whom these developments are “painful”, relied on the court’s decision. The latter will be known on February 8 and should, if it is positive, postpone the possible trial of Cédric Jubillar by several months.
Delphine Jubillar, mother of two children, disappeared from her marital home in Cagnac-les-Mines (Tarn) on the night of December 15 to 16, 2020. At the time of her disappearance, she had decided to divorce to start a new life with another man I met the previous summer. Despite extensive searches carried out in Cagnac, no trace of the nurse has been found for three years.
