In the trial surrounding the fatal shooting of a 16-year-old teenager in Bramsche, the Osnabrück regional court sentenced an 82-year-old. He has to be imprisoned for 13 years for murder.

The district court ruled on Monday that the man should be placed in a psychiatric clinic because of a mental illness. The presiding judge gave the reason for the verdict that the 82-year-old was responsible for the crime. On the morning of the crime, he was already waiting for the teenager in front of the house with a loaded gun. When the 16-year-old came out, the man shot him directly, first in the leg, then twice in the head. This targeted action suggested to the judge that it was murder and not manslaughter. According to the judge, the defendant was aware that his victim did not expect the attack and could not defend himself.

Imaginary noise was the motive for action

According to the judge, the convicted man suffers from a delusional disorder that has developed into paranoid schizophrenia. He had repeatedly complained about noise in the neighborhood for several years, especially from the 16-year-old and his mother. The man said the noises he heard were unbearable. The judge explained that the defendant was convinced that the neighbors were making noise on purpose to disturb him. The judge explained that the condemned man also heard noises that weren’t even there. For example, he said there was a machine running in the victim’s apartment that sounded like a locomotive. The defendant even insisted on an inspection with the landlord so that he could hear the noise. But he couldn’t hear anything except everyday noises. The 82-year-old said in court that he could no longer stand “the noise.”

Student dies from gunshot wounds

The man then shot the 16-year-old several times on February 28th. The student, who lived with his mother in the same apartment building as the defendant, died as a result of his injuries. In its plea, the public prosecutor’s office had called for a prison sentence of 14 years and that the defendant be placed in a psychiatric hospital. The reason: As a result of his condition, further significant illegal acts are to be expected. The defense attorney, on the other hand, pleaded manslaughter instead of murder and therefore advocated a prison sentence of nine and a half years and placement in a psychiatric clinic.
