Why the Scheuer case is not suitable as a foil for ministerial liability – Opinion

Of course, the need to be able to prosecute the ex-minister financially for the million-dollar debacle with the toll is understandable. But those who tighten the law too boldly may end up having the opposite effect.

The fact that Volker Wissing (FDP) is now letting experts consider whether his predecessor at the head of the Federal Ministry of Transport can perhaps be held personally and financially liable for the expensive toll debacle certainly has more to do with a need for legal clarification. Legally, there is not much to be gained there, a ministerial liability is simply not provided for. But politically it can be useful before the Bavarian elections to keep the spotlight on the CSU man Andreas Scheuer for a while – now that the anger about the 243 million man is blazing so nicely. That is allright. Scheuer would certainly not have done things differently in Wissing’s place.
