For the past six years, the Bavarian police have had extensive opportunities to take people into custody as a preventive measure, and since July 2021 the duration has been capped at a maximum of two months. This means of so-called preventive detention is also so controversial because it was last used on climate activists – locked up for weeks because it was feared that they would disrupt road traffic. However, as has now become clear, the Bavarian Constitutional Court has no objections to this.
