BGH confirms partial acquittal for NSU helpers


The so-called NSU trial came to a legally binding conclusion with the rejection of two revisions in connection with the conviction of André E. on Wednesday in Karlsruhe. André E. was sentenced in 2018 by the Munich Higher Regional Court to two and a half years in prison for supporting a terrorist organization, but was acquitted of the charge of complicity in murder. The federal prosecutor, however, had demanded twelve years and appealed on this point because of the partial acquittal of the Munich judgment. The defendant himself also appealed against his conviction. The Federal Court of Justice in Karlsruhe has now rejected these revisions. Essentially, the Federal Prosecutor’s Office saw gaps in the reasons for the judgment regarding the offense – Judicial assessment of intent. And the Federal Court of Justice did not share this assessment. ” The Federal Prosecutor’s Office was correspondingly disappointed. We considered the underlying evidence to be flawed and therefore lodged the appeal on appeal, which we did not get through to the Federal Court of Justice. ” Between 2000 and 2007, the “National Socialist Underground” (NSU) murdered nine men of Turkish and Greek origin and a female police officer. The racist motives for the murders had not been recognized by the investigators for years. It was only after the main perpetrators Uwe Böhnhardt and Uwe Mundlos committed suicide during a police check in 2011 that the background to the murders and the NSU network were discovered. The two men had lived together with Beate Zschäpe under false names. Zschäpe’s job was to manage the NSU’s finances and provide alibis. The main defendant in the NSU trial must remain in custody for life. With the judgment against André E. all judgments are now final.
