Twin towers developer threatens legal action after project cancellation

The Hermitage company, carrier of the twin towers project in the district of La Défense rejected the day before, denounces, this Tuesday, an “incomprehensible and disturbing refusal” and “gives notice” to the local public establishment to sign the promise to sell.

The board of directors of the local public establishment Paris La Défense announced on Monday that it had decided not to approve the sales agreements with Hermitage for its project in the business center, considering that the situation did not allow for conclude a transaction “under conditions acceptable to the public establishment, particularly in view of the absence of financial and technical guarantees provided by the project leader”.

The project, named “Hermitage Plaza” and initiated by the Russian promoter Emin Iskenderov, consisted of the construction of two skyscrapers 320 meters high with luxury residences, offices, hotels and shops, instead. of apartment buildings built in 1974.

In its press release, Hermitage said he was “amazed to note that Paris La Défense did not respect its commitment by arguing fallacious elements to sign the promise to sell before December 31, 2021 as provided for by the protocol of March 24, 2021 which arose out of judicial mediation ”.

He denounces an “incomprehensible and disturbing refusal”, “a surprising turnaround” and “recalls having worked for thirteen years and having invested 350 million euros for an emblematic project and on the basis of a partnership agreement made by a public establishment of the State since taken over by Paris La Défense ”.

According to Hermitage, “false information was apparently leaked internally during the council [d’administration] ”Of the public establishment of December 28“ relating to the reality of the commitments and the quality of the project partners ”.

One billion euros in damages

The company claims in particular to have “produced proof of the firm commitment of a leading international financial institution to provide the necessary financing for[il] fulfills its obligations under the promise to sell, for an amount of 280 million euros, thus offering the required financial guarantees ”.

She “gives notice to Paris La Défense to sign this promise to sell” and indicates that “in the absence of this signature, Hermitage will resume its proceedings, in particular the request for one billion euros in damages” – to which it had previously waived during mediation – “notwithstanding a request for enforcement and other proceedings for abusive termination and disloyalty”.
