With his SUV, the man repeatedly rams the vehicle in which his ex-girlfriend is sitting with her new partner. The woman is injured, both can escape. The SUV driver receives a suspended sentence.

A 76-year-old driving instructor on two counts of attempted murder has been sentenced to a suspended sentence of one year and six months.

The judges at the Baden-Baden district court found the man guilty of dangerous bodily harm and property damage on Friday (1Ks 300 Js 12741/20). The man was acquitted of the remaining charges.

The public prosecutor had accused the man of repeatedly ramming his SUV in the summer of 2020 in the car of his much younger ex-girlfriend, in which his new partner was also sitting. He is also said to have approached her when she left the car. The suspect is said to have acted maliciously.

The woman suffered bruises and bruises, but both were able to escape. The accused turned himself in to the police. In addition to attempted murder, the defendant, who had no previous convictions, was accused of two counts of dangerous interference with traffic, dangerous bodily harm, damage to property and hit-and-run accidents.

Just wanted to destroy car

At the start of the trial at the end of March, the 76-year-old admitted that he had intentionally rammed his ex-girlfriend’s car several times. But he didn’t want to kill her, he said, he just wanted to destroy the driving school car.

The possible motive combines private and professional: the woman had separated from the 76-year-old and, as the owner of the driving school, resigned from the driving instructor, who was also the managing director. The new friend should also work as a driving instructor in the company.

The court also revoked the man’s driver’s license and imposed a driver’s license ban. The authorities are not allowed to issue a new driving license to the driving instructor for the next year and a half. The judges also determined that the ex-girlfriend, who was a joint plaintiff at the trial, is entitled to damages for personal injury.

The public prosecutor’s office had called for a suspended sentence of one year and ten months and a driver’s license ban for three years. The man’s defense attorney had spoken out in favor of an eight-month suspended sentence. The judgment is not final yet.
