Last year, a 32-year-old from Munich filmed the bathers who were changing their clothes under the changing rooms in the Westbad. The man was caught red-handed and was therefore now charged before the Munich District Court: Violation of the very personal sphere of life by taking pictures and creating child pornography, that was the official charge. District judge Ines Tauscher stopped the case against the accused – because he has to serve a much higher sentence in another matter.
Mario R. crouches in the dock, a pale man with almost youthful features. He wears his hair shaved on the sides, the top hair is tied in a pigtail. He quietly mumbles his date of birth and his name, that’s all he will say on that day. According to research by the public prosecutor, the single man filmed several bathers in the changing rooms with his cell phone in the Westbad in January 2020. Three recordings were apparently secured. Once you can see an eight year old girl and a man, then a girl with his mother and an eight year old boy. Mario R. was seen and caught filming. According to the indictment, however, not all of the victims could be identified.
“This is not the first time we have been here,” says Judge Tauscher, alluding to a hearing in April of this year: At that time, Mario R. sentenced her to two years and four months’ imprisonment for sexual assault and sexual assault. During the negotiation at the time, the dirty videos from the Westbad were also in the room, and Mario R. is said to have admitted the acts and attributed them to his drunkenness.
The single man, who among other things worked for a security company, has already had several criminal records for possession of child pornography, theft with a weapon and fraud. Because of the latter conviction, he was still on probation.
At the April trial, prosecutors accused him of sexually assaulting a 14-year-old girl. The young person should clean his apartment for a fee. After arriving at the apartment, he locked the door and removed the key. While the girl was sucking, he appeared in the living room wearing only a pink towel. He dropped the towel, touched himself and grabbed the girl in the process. Mario R. denied the facts at the time, but Judge Tauscher believed the girl and sentenced R. to imprisonment.
After reading out the indictment of the incidents from the Westbad, the parties involved now meet behind closed doors for a legal discussion. Defense attorney Claudia Enghofer then talks to her client for a good three quarters of an hour, the sooner he gets involved in the following deal: He withdraws the appeal in the case of the 14-year-old girl, but the court suspends the current proceedings. R. is taken away and continues to sit in prison.
