The husband’s fellow prisoner released in exchange for his testimony? The prosecution denies

Thursday, for four hours, Cédric Jubillar was confronted in the office of the investigating judges with his former fellow prisoner, “Marco”, to whom he allegedly confessed to having killed and buried his wife Delphine, who had been missing since the night of December 15 to 16, 2020 in Cagnac-les-Mines. According to the lawyers of the husband, indicted since last June for the murder of his wife, this face-to-face did not lead to new revelations. But the latter repeated several times that they wondered how justice could have trusted “Marco”.

And questioned the conditions of his release, only a few days after he confided in the gendarmes. “If the prosecution is there, trying to base a case on the statements of a man who obviously paid off, or in any case had the benevolence of a court which changed in five days to be put back in freedom is that really, the prosecution has nothing in this case, “said one of them, Alexandre Martin, after the confrontation.

The reliability of the witness

A suspicion that could raise doubts about the reliability of this witness. And that the public prosecutor decided to lift this Friday by responding to the defenders of the main suspect. In a press release, the head of the Toulouse public prosecutor’s office, Samuel Vuelta-Simon, recalls the chronology of the facts, when on September 28, 2021, “Marco” decided to contact the investigators who heard him the next day.

“At the time of this process, he was serving a one-year prison sentence in the Seysses prison center for the insults and threats committed in 2018 against prison administration officers. He was released the next day, when his sentence ended. This witness had also been detained on remand since August 6, 2021, in the context of another case, also of insults and threats against prison administration officers, but committed in 2016. At the request of his lawyer, the Toulouse Criminal Court placed him under judicial supervision on October 4, 2022, pending the judgment hearing. This judicial control was respected, ”explains the public prosecutor.

On November 18, he was finally tried and sentenced for these facts, and the court “ordered the confusion with the sentence already served, under the conditions provided by law”.

“Neither asked nor obtained favor”

“These two decisions, fully reasoned, were taken by two different collegial compositions of the Toulouse court. Therefore, this witness neither asked nor received any favor in exchange for his testimony, nor was it promised to him. The only benefit he has been able to receive is that of the application of the criminal law,” concludes Samuel Vuelta-Simon.

The testimony of “Marco” had led the investigators to launch new excavations near a burnt farm where Cédric Jubillar would have confessed to him to have buried the mother of his children. This had also led to the custody of the suspect’s new companion, Séverine, the gendarmes wanting to check whether she had participated in moving Delphine’s body. A forty-year-old to whom “Marco” had given a letter that Cédric Jubillar had entrusted to him, and whom he had met several times. Finally, these new investigations had not made it possible to find the body of the missing nurse.

In less than a month, a year after his placement in pre-trial detention, Delphine’s husband will again be before the judge of freedoms and detention for the renewal of his warrant of committal.
