For now, the health pass remains mandatory to access the largest shopping centers in the Alpes-Maritimes. Seized by 34 individuals, the Council of State made this Monday
a decision in this direction. But with an incidence rate that continues to drop – now at 180 cases of Covid-19 per 100,000 inhabitants in the department – the presentation of the QR code could quickly no longer be required.
In the meantime, the summary judge considered that “this obligation pursues a public health objective” and that “many shops exist nearby where people without a health pass can obtain the same basic goods and services”, specifies the Council of State, “urgently seized by individuals”.
Financial and commercial damage for one of the centers
Before the examination at the Council of State, the Administrative Court of Nice had however suspended the measure in only one of the six establishments concerned, “La Galerie Géant Mandelieu”, at the request of its manager. The court considered “that the condition of urgency”, a sine qua non condition for referral to the summary judge, “was met, having regard to the financial, commercial and contractual damage of the applicant company”.
Cap 3000, Auchan la Trinité and the three Carrefour stores in Nice and Antibes are still affected by the health pass.
