“Nothing prohibits the sale of this file, on the other hand, as it is not possible for us to know if the future buyer was going to comply with the GDPR obligations, we preferred to withdraw it”, confirms to 20 minutes Bruno Decock, head clerk for Wednesday’s sale at Mercier & Cie.

Not necessarily the end of the story of the file

Anyway, according to our interlocutor, of the 12 buyers interested in the lot including the file, only two wanted to recover the data of Camaïeu customers, the others only wishing to acquire the brand. And on the shortfall for the liquidator, it is almost negligible, “around 150,000 or even 200,000 euros, half of the customers being inactive”, according to the clerk.

End of the story then? Not necessarily. Inseparable from the brand, the data cannot be the subject of a new sale. However, whoever wins Wednesday’s auction will still be able to retrieve the file. “For the buyer, it will be a question of negotiating directly with the liquidator of Camaïeu, who will be able to transfer the file to him if he presents the necessary guarantees”, specifies Bruno Decock.
