More than four and a half years after the fatal accident on a Rosenheim bypass road, the Rosenheim speeding process has legally come to its final end. The families of the two young women who were killed are foregoing a further appeal, as they are now, following the most recent ruling by the Traunstein Regional Court Upper Bavarian Volksblatt have communicated. Since the public prosecutor’s office is not filing any further appeals, the surprising acquittal for one of the three young car freaks who are said to have caused the accident is now final.
A number of judges and criminal chambers had previously been of the opinion that the three drivers had performed an overtaking maneuver on a November evening in 2016, in which two locals in their BMW no longer allowed an outsider to cut into his Golf, so that he headed on the oncoming one Young women small car crashed. A suspended sentence of one year and eight months for the golf driver became legally binding after the first instance, and the Traunstein district court later confirmed and partially tightened the two-year prison sentence against the BMW driver. However, the chairman made a formal error in that he only allowed a defendant to briefly leave the room by show of hands instead of a resolution. The Supreme Court saw this as a reason for appeal. In the next attempt in front of another Traunstein chamber, this driver, who had been punished most severely so far, was acquitted in case of doubt at the end of June, while the driver of the BMW in front was serving his sentence. A further instance could not have been able to rely on more than the observations of witnesses, which the district court were no longer sufficient for a conviction, which happened further and further back.
