Among other things, the Office for the Protection of the Constitution has classified the so-called AfD wing as a secured extremist effort. On the other hand, the party wants to take action again after a defeat in court.

After the classification of The North Rhine-Westphalian Higher Administrative Court has now extended the AfD as a suspected case by the Office for the Protection of the Constitution and a defeat of the party before the Cologne Administrative Court.

According to a court spokeswoman in Münster, the AfD now has until the end of September to comment on the response to the appeal from the Federal Office (BfV) received in July 2023 in three appeal proceedings.

When there will be a specific date for an oral hearing, it is still not possible to say at this time, the court said when asked. The court files currently comprise around 10,000 pages and several hundred supplementary files, which would fill an entire room in the Higher Administrative Court building.

That’s exactly what it’s about

It is about the classification of the so-called AfD wing as a suspected case and as a secured extremist endeavor (Az.: 5 A 1216/22) as well as the classification of the Young Alternative as a suspected case (Az.: 5 A 1217/22) and the classification of the AfD as a suspected case (Ref.: 5 A 1218/22).

According to its own information, the OVG will first deal with the AfD’s application for temporary legal protection made on July 11, 2023 (Az.: 5 B 757/22). This is about the 2022 report for the protection of the constitution. Until a decision has been made on the main issue, the BfV should be obliged to refrain from “classifying, observing, treating, examining or managing the AfD as a suspected case and publicly announcing this, as well as to refrain from classifying the AfD as a secured extremist movement and to publicly announce this.”

In the summer of 2022, the AfD appealed against three judgments of the Cologne Administrative Court, which had been issued in March 2022 in favor of the Office for the Protection of the Constitution. The Higher Administrative Court in Münster must now decide on this.
