Whether in the garden, on the terrace or on the balcony: According to the German Tenants’ Association, tenants are generally allowed to grill. But: This only applies as long as it is not expressly forbidden in the rental agreement. In Hamburg, for example, a prohibition clause for barbecuing on the balcony is usually common in rental contracts. If you don’t comply, you risk a warning or even dismissal. In addition, if you are barbecuing on the balcony or terrace, you must ensure that the neighbors are not affected by excessive smoke development. If this is the case, there is even a risk of a fine. How many times a year the grill can be lit on the balcony is regulated differently in each federal state. The Bavarian Higher Regional Court considers five times a year to be appropriate, the Stuttgart Regional Court three times a year. Provided that barbecuing is not prohibited in your rental agreement, the following always applies: communication is the magic word. Let your neighbors know in good time and grill in such a way that no one is disturbed.
