No, you do not have to sign a liability waiver before getting vaccinated

We knew André Bercoff “in all his forms”, every day from 12 p.m. to 2 p.m. on Sud Radio, but we certainly did not expect such a level of bewilderment. The journalist and presenter, polemicist at his leisure, read, Wednesday, June 30, a mysterious document to his listeners. A document that must be signed, according to him, by all people being vaccinated against Covid-19. And – scandal – which would release the State, like the pharmaceutical companies, of any responsibility in the event of serious side effects induced by the vaccination.

“When you go to be vaccinated, you are made to fill out a paper. With the signature, [la mention] “Made in Paris”, and you approve the terms (sic). I am going to read you just one paragraph, which says this: “Note that compensation for damage or serious side effects from the pharmaceutical companies producing these vaccines is impossible, because they are released from all liability. elsewhere the government and health authorities reject all responsibilities, vaccination being assimilated to a voluntary non-compulsory act for which the patient assumes full responsibility […]. In the event of serious bodily injury – it is written, eh, this is what patients are made to sign – disability or death, the patient cannot necessarily claim financial compensation, nor his medical insurance. , or his life insurance. “That’s what the paragraph says word for word about patients who are vaccinated.”

This sequence, taken up by an Internet user calling not to sign “a paper which relieves the labs and their accomplices of responsibility!” Was then widely shared on Twitter. Problem: this text read on a national radio at prime time by André Bercoff, is in reality only a vulgar fake, produced by a Swiss disinformation site.

FAKE OFF

If you have already been vaccinated against Covid-19, you probably already know that you were not made to sign such a waiver, and that the document cited by André Bercoff does not exist. The latter comes from the anti-vaccination site Réinfo Santé Suisse International, which presents itself as the Swiss counterpart of the Réinfo Covid collective, another disinformation site animated, among others, by Doctor Louis Fouché.

On Twitter, an Internet user traced the source of this enigmatic text. The latter, since deleted by the Swiss site, is however still visible in
archived version.

The document, created from scratch by the collective, is neither an official Swiss nor French document, and has absolutely no legal value. It is a series of anti-vaccination arguments aimed at casting doubt on the benefits of vaccines. You will be able to read on the document, in addition to the passage read by André Bercoff, that with the anti-Covid vaccine, “you agree to enter into the framework of a medical experiment”, or that the benefit / risk balance of the vaccine is based only on assumptions … False information.

You can also read that “11,500 post-vaccine deaths” were reported on May 15, 2021 in the EU according to the pharmacovigilance database of the European Medicines Agency (EudraVigilance). But what the collective is careful not to tell you is that the deaths and side effects reported in this database “do not reflect any confirmation of a potential link between the drug and the observed effect (s) ( s) ”, as EudraVigilance writes on its website.

“In a pharmacovigilance database, cases of deaths occurring in people who have been vaccinated will be reported, regardless of the link between the vaccine and death. They are specifically reported for evaluation and to determine if any may be related to the vaccine. To consider them to be due to the vaccine is a profound ignorance of the content of these databases, ”explained Antoine Pariente, director of the regional pharmacovigilance center of Bordeaux, a few days ago, to 20 minutes.

In the event of a problem, whether in Swiss or in France, you will not be deprived or left behind. In France, and since December 2020, the National Council of the Order of Physicians has requested that health professionals and their patients be able to benefit from the same legal certainty with anti-Covid vaccines as for a vaccination obligatory. “Full compensation for any medical accidents attributable to acts carried out during the vaccination campaign” is thus provided by the National Office for Compensation for Medical Accidents (Oniam), a public body placed under the supervision of the Ministry of Health.

According to the latest report from ANSM (National Agency for the Safety of Medicines), the “vast majority” of adverse effects recorded in France since the start of the vaccination campaign “are expected and not serious”. Data which “confirms the favorable benefit / risk balance of all the vaccines used in France in the populations targeted by the vaccine strategy”.
