New eviction from a HLM after a conviction for drug trafficking

A new termination of the lease of housing in HLM was confirmed by the courts on April 8 in Nice. Côte d’Azur Habitat, the largest social landlord in the Alpes-Maritimes, had seized the court after the tenant was sentenced to twenty months in prison for drug trafficking in May 2020. The traffic taking place within his residence, in the Louis Braille district, east of Nice, had “repercussions on the lives of other residents”, explains a press release relayed by Côte d’Azur Habitat.

To justify this decision, the justice indicates that “the correctional judgment convicting the tenant makes it possible to demonstrate the reality and the seriousness of the nuisances invoked by Côte d’Azur Habitat which are at the origin of significant disturbances for the tranquility of the other tenants. “.

Since October 2020, a reform of the internal regulations of HLM rental contracts has facilitated evictions in the event of criminal convictions of a tenant or a person living under his roof.

Six months later, an agreement between the prosecution and the Alpes-Maritimes prefecture was also signed to inform the social landlord of the tenant’s legal cases in order to initiate proceedings. Thus, the social landlord recalls that this device allows him to “fight effectively against all forms of nuisance” boasting that “justice supports it” and indicates that “132 other eviction requests are in progress”.

In September 2021, a first HLM eviction case was publicized. The mother of a young man, also convicted of drug trafficking, had to leave her home because of her son’s activities and the judgment.
