In the Charlotte Böhringer murder case, the lawyer for Benedikt T., who was sentenced to life imprisonment for murder, has again applied for the retrial of the proceedings and a new main hearing. The millionaire was found dead in her penthouse apartment in May 2006.

In his 375-page letter to the Munich I public prosecutor, Peter Witting justified the application with two new aspects in the case that had become known as a parking garage murder: On the one hand, knowledge gained this year indicated that two witnesses gave false testimony in the process , which had an effect on Ts in the court’s assessment of the evidence. On the other hand, several criminal reports from various institutions, arranged by T’s family, suggested a completely different course of events than the court assumed at the time; also the delimitation of the time of the crime can no longer be maintained.

Benedikt T., a nephew of the victim, was found guilty in a trial in August 2008 after 93 days of trial. The verdict is still controversial today, T. protested his innocence from the start. So there is no confession, no eyewitnesses or any instrument used in the crime that was found. For his verdict, the judge then forged a ring of circumstantial evidence from 14 parts, in which he included, among other things, T’s left-handedness as incriminating – although the perpetrator had without exception struck with his right hand, as the chamber itself determined.

With the new evidence, the ring of circumstantial evidence has now broken open in other places, according to Witting’s argument. Therefore, his client “can no longer be denied a retrial”. The attorney previously filed retrial petitions in 2012 and 2019; Despite the obvious inconsistencies in the judgment, they were rejected as inadmissible by the Augsburg Regional Court.

Because this court is also scheduled for retrial in its district this year by the Munich Higher Regional Court, Witting has also applied for a different district to be entrusted with the process this time.
