Munich: The Glück company withdraws from gravel mining in the forest of Kasten – Munich

The Glück company in Graefelfing is turning around in gravel mining in Forst Kasten: The company is giving up the appeal proceedings against the Heiliggeistspital Foundation before the Munich Higher Regional Court. The company announced on Wednesday. As the owner of the forest, the foundation had awarded a 9.5 hectare forest area for gravel extraction to a competitor through a tendering process. The Glück company sued for failure to take into account in the proceedings, which was dismissed by the Munich I Regional Court in December of last year. The company then appealed.

The decision means the withdrawal of the Glück company from the Forst Kasten. In about four years, the gravel stocks in their current mining areas will be exhausted. The company is no longer relying on further mining in the forest – Managing Director Markus Wahl said that in an interview with SZ in June, he had “written off” the forest box. The family-run company Bernhard Glück Kies-Sand-Hartsteinsplitt GmbH will in future rely on gravel mining in an 11.4 hectare forest area in Lochhamer Schlag.

The company describes the withdrawal from the appointment procedure as the “logical consequence” of a “dialogue-oriented corporate culture” that the company has recently been promoting. Wahl no longer thinks it makes sense to force an exchange with the foundation through legal action. In the future, the company will rather focus on a “proactive design dialogue” with citizens and close coordination with the authorities, according to a statement. Even in the event of a positive outcome of the appointment procedure, the company no longer sees a viable basis for a joint business relationship with the foundation.

For Munich city councilors, the end of the appointment process should mean relief. In their function as members of the board of trustees, they had to approve the award to the Huber brothers in a controversial voting process in the city council. Otherwise they face possible personal liability should the Huber company make claims for damages. Possible claims for damages by the Glück company as a result of a successful appeal procedure are now excluded in any case.
