Munich Regional Court: Kitchen helper is said to have raped a 15-year-old – Munich

Apparently the defendant Kaya L. does not have the fondest memories of his relationship with his former girlfriend. The 21-year-old kitchen helper from Olching and the 15-year-old Nuri Z. (both Name changed) from Munich met in November 2020 via a social network on the internet. At first the relationship was “okay,” “then it wasn’t so good,” and it “just didn’t fit together,” says Kaya L. looking back. Recently there have been more and more “quarrels and discussions” between his girlfriend and him. But according to the public prosecutor’s office, much more happened: Now the 21-year-old is standing before the youth chamber at the Munich II Regional Court. The investigators’ accusation: He is said to have raped the underage Nuri Z. three times and beaten her several times.

When Kaya L. is led into the meeting room by two judicial sergeants, he is in a great mood. Dark suit, white shirt, open collar. The 21-year-old smiles at his relatives in the audience and greets them. Kaya L’s defense attorney, lawyer Andreas Schröger, makes a statement on behalf of his client. It is very short: “The allegations of sexual assault and rape are denied,” said the lawyer. There was only “consensual sex” with the 15-year-old, either at meetings in Olching or in Munich. However, the physical injuries – Kaya L. is said to have hit Nuri Z. in the face several times with the palm of her hand during arguments – would be admitted. In his interrogation, Kaya L. speaks of the “slaps” that he gave the 15-year-old.

Before L. himself comments on the allegations, at the suggestion of the defense attorney there is a legal discussion between the court, the public prosecutor’s office and the defense. The 21-year-old’s lawyer is calling for the arrest warrant against his client to be suspended or revoked. The rape allegations have now “shrunk down,” he claims. Judge Martin Hofmann says that this application was to be expected “given the contents of the file.” That means there are apparently doubts about the alleged victim’s statements. Because even the representative of the public prosecutor’s office leaves it to the discretion of the court to at least deactivate him. Kaya L. would then be released from custody immediately. But the court does not want to decide on this for the time being.

The 15-year-old from Munich will be questioned in camera in the afternoon. But before that, Kaya L. described what allegedly happened. The alleged sexual assaults did not take place, he assures again. He gave Nuri Z. a “clap,” yes. “I’m sorry,” said L. Judge Hofmann wants to know whether he threatened her with a knife. “All I can say is that I don’t own a knife,” assures the kitchen helper. Did he hit Nuri Z.’s head against the windshield of a car during an argument? No, is the answer here too. “If I have done something, then I say that I have done something,” emphasizes Kaya L. The process continues.
