Munich prohibits delivery service Gorillas from operating in Lothstraße – Munich

Noise late into the night, parked driveways and lanes: the authorities intervened after massive protests. The delivery service could sue against the decision, but has not commented so far.

The supermarket delivery service Gorillas does not receive a license to operate its distribution center at Lothstraße 3. The negative decision has already been sent to the company, and the city has also issued a ban on use. The Neuhausen-Nymphenburg district committee also sees this as a success of its work. The responsible planning department had already indicated in a draft resolution in July how it would decide “due to the problematic delivery”.

Months ago, district representatives from Neuhausen and Maxvorstadt, as well as the Neuhausen citizens’ assembly, had demanded the immediate closure of the logistics center. The reason for this was massive protests from residents. Vehicles almost permanently blocked driveways and the passage of the street, it was said that buses and fire engines could no longer get through. In addition, there is noise and exhaust fumes well into the night. A neighbor explained at the town hall meeting in May that he now suffers from “massive insomnia”. According to the Local Building Commission (LBK), however, the “necessary legal requirements” were initially lacking for an immediate ban on use.

First of all, the building code had to be used to check whether the project “fits in with the relevant immediate surroundings in terms of the type and extent of the structural use”. It probably doesn’t: The approval authority expresses “particular concerns about the operating times and the emissions caused by delivery traffic”. The company must not “violate the principle of consideration”. There were talks and discussions, but according to the LBK they did not lead to “a satisfactory result”.

As early as spring, the city administration had rejected an application by gorillas to change the use of a shop on Schwabing’s Angererstrasse – with reference to inadmissibly long operating times, which violated public law regulations. The camp should be open from six in the morning until midnight. In contrast to the delivery branch on Lothstraße, the Schwabing location was still in the planning phase. Gorillas now has the opportunity to appeal the decision. The company does not want to comment on this when asked.
