Munich: ÖDP fail with green space complaint – Munich

In a letter on Thursday, the government of Upper Bavaria rejected a petition by the city council faction ÖDP/Munich-List, with which they had demanded that various decisions by the Munich city council be reviewed and, if necessary, declared ineffective. In the complaint filed at the end of May, the ÖDP and Munich-List complained that the citizens’ initiative “Preserve green spaces” adopted by a majority of the city council in the spring was simply ignored when decisions were made on construction projects. The ÖDP listed eleven measures in this regard.

The government of Upper Bavaria has now come to the conclusion “that there is no reason for a legal objection”. In each individual case, she granted the state capital a leeway to weigh up its interests and those of the citizens’ petition. In addition, the municipal supervisory authority pointed out that the city council decisions mentioned relate almost exclusively to certain stages of the procedure and that no final decisions have been made.

Simultaneously with the complaint to the government of Upper Bavaria, the ÖDP and the Munich list had announced a petition to the Bavarian state parliament. They want to use it to ensure that citizens’ requests can no longer “be taken on as an alibi, but actually have to be implemented noticeably”. In this case, an answer is still pending.
