Children’s noise may get on your nerves, but you can’t have it banned by the courts. According to the Federal Immission Control Act, it does not represent a “harmful environmental impact”. This means that residents who want to take legal action against noise from playgrounds or daycare centers are looking for help in building law. The eastern end of Arabella Park was once again the scene of such a court hearing on Monday. The presiding judge Josef Beil has not yet announced a verdict, but the trend was clear: the plaintiff will not get through with his demand to ban playing in parts of a daycare garden.
