Maintenance payments: Separated children are entitled to a little more money

From January, dependent parents have to pay a little more money for their children. According to the new “Düsseldorf table”, however, the increase is in many cases less than one percent.

At the turn of the year, those liable for maintenance have to pay higher payments for their underage children. From January 1, the requirement rates for child support will be increased slightly in the new so-called Düsseldorf table, as the Higher Regional Court (OLG) Düsseldorf announced.

The minimum maintenance for a child up to and including five years of age increases by three euros to 396 euros. For boys and girls up to and including the age of eleven it is 455 instead of the previous 451 euros, for children up to and including 17 years of age it is 533 instead of 528 euros. For children of legal age who still live in the same household as one of the parents, the maintenance rate increases from 564 to 569 euros. These minimum values ​​apply to a net income of up to 1900 euros.

Five additional income levels

The higher the income, so the higher the rates. According to the OLG, the table has also been expanded to include five income levels. So far it has ended at 5500 euros, in future the highest level will be a net income of 11,000 euros.

Child benefit is partially or fully offset against the amounts. The deductibles – i.e. the minimum that must remain with the person liable for maintenance – will remain unchanged in the coming year. For parents who are not gainfully employed and who have dependent and unmarried children under the age of 21, the amount is at least 960 euros. Employed persons are entitled to at least 1160 euros.

The “Düsseldorf table” was last adjusted on January 1, 2021. It is the guideline of all higher regional courts in Germany for the determination and assessment of child support, but has no binding legal effect.
