In a civil law proceeding, the Aschaffenburg Regional Court sentenced the Lower Franconian District President Erwin Dotzel (CSU) to pay a monetary compensation of 750 euros. Dotzel is said to have a party friend in 2021 referred to as a “right louse” in a group chat. The plaintiff, said CSU member, had applied for compensation for pain and suffering of 12,750 euros.
The grounds for the judgment state that Dotzel retracted the statement in question in a press article, but attested to the plaintiff’s “right attitude”. This represents an encroachment on the plaintiff’s personality rights. The widespread use and the negative consequences for the plaintiff must be taken into account – even if Dotzel made it clear that the term “right attitude” was not meant negatively, but as a designation for a conservative basic orientation . The judgment is not final. Criminal proceedings are also pending against Dotzel at the District Court of Obernburg for insults.
