Landshut: death after mistaken medication – suspended sentences – Bavaria

The Landshut district court sentenced the employees of a nursing home in the Dingolfing-Landau district to suspended sentences. It was no longer possible to clarify whether the wrong drug was the cause of death.

In the second trial of a serious mix-up of medication in a nursing home, three employees were found guilty of failing to provide assistance. The two women and a man were sentenced to suspended sentences of six, four and two months in front of the Landshut regional court on Friday. The judgment is based on a mutual agreement, said the presiding judge Ralph Reiter. The proceedings began in May of this year with a lengthy interruption.

The employees of the home in the Dingolfing-Landau district were charged in a first trial after a seriously ill patient died in 2016 after mixing up drugs. It was no longer possible to clarify whether the wrong drug was the cause of death. The charge was murder through omission. In 2019, the two nurses and their boss were convicted of attempted murder before the Landshut regional court. However, the Federal Court of Justice (BGH) saw errors in the judgment and referred the case back.
